Under the proposed ordinance, Dane County would have the right to refuse bidding or terminate contracts with employers who violate labor laws.

The ordinance addresses a lack of enforcement authority under the current laws. For example, when Superior Linen was cited for 21 unfair labor practices by the National Labor Relations Board, the County discovered that such abuses alone were insufficient cause to terminate their contract.

Dane County’s proposed Fair Labor Standards Ordinance requires all new contracts with the county to indicate any labor violations, specifically those by the National Labor Relations Board (NLRB) and the Wisconsin Employment Relations Commission (WERC). A violation would result in a termination, suspension, or cancellation of the contract.

The ordinance also requires that all contractors and their subcontractors post a statement, ‘in a prominent place visible to employees’, detailing the rights of workers to form unions without employer retaliation.
